TERMS AND CONDITIONS
1. General
These Terms and Conditions apply to services provided by Mediawok Co., Ltd., trading through Camera Crew Thailand. Unless otherwise agreed in writing, they form part of all quotations, bookings and agreements between Mediawok Co., Ltd. and the client.
2. Quotations and Bookings
All quotations are based on the information available at the time of quotation and are subject to availability. A booking becomes confirmed once the client accepts our quotation or booking confirmation in writing.
Any significant changes to the scope, schedule, location, crew, equipment or other production requirements may result in additional charges. Where possible, these will be communicated to the client in advance.
3. Rates and Working Hours
Crew, equipment, transport and other production services are charged according to the rates and conditions stated in the relevant quotation.
Where a quotation specifies standard working hours, overtime may be charged when those hours are exceeded. Additional costs resulting from schedule changes, delays or requirements outside the agreed scope may also be charged.
4. Payment
Payment terms will be stated in the relevant quotation or invoice. Deposits or advance payment may be required to confirm certain bookings, particularly where third-party costs are incurred on the client's behalf.
Bank charges and other transaction fees are the responsibility of the client unless otherwise agreed.
5. Cancellations and Changes
If a confirmed booking is cancelled or postponed, cancellation charges may apply depending on the notice given and any costs already committed.
Third-party costs that cannot be cancelled or recovered, including crew, equipment, locations, permits, transport, accommodation and other production expenses, remain payable by the client.
Specific cancellation terms stated in a quotation or booking confirmation take precedence over this general provision.
6. Crew and Equipment
We will make reasonable efforts to provide the crew, equipment and services specified in the confirmed booking. Where circumstances outside our control make a particular crew member or item of equipment unavailable, we may provide a suitable alternative of comparable professional standard.
The client must use any equipment supplied or arranged by us responsibly and in accordance with instructions provided by the crew or supplier.
7. Locations, Permits and Permissions
Where agreed as part of our services, we can assist with filming permits, location permissions and other production requirements.
Approval remains subject to the relevant authorities, property owners and other third parties. We cannot guarantee that any particular permit or permission will be granted.
The client is responsible for providing accurate information about the intended production and use of the material where this is required for applications or approvals.
8. Client Responsibilities
The client is responsible for providing accurate production information, schedules and requirements and for informing us promptly of any changes.
Unless specifically included in our quotation, the client remains responsible for obtaining any rights, releases, licences or permissions relating to scripts, trademarks, music, contributors, talent or other material supplied or commissioned by the client.
9. Weather and Circumstances Beyond Our Control
Productions may be affected by weather, government restrictions, transportation disruption, illness, natural disasters, technical infrastructure failures or other circumstances beyond our reasonable control.
We will make reasonable efforts to find practical alternatives, but we cannot be held responsible for delays, cancellations or additional costs resulting from circumstances outside our control.
10. Liability
Mediawok Co., Ltd. will perform its services with reasonable professional care.
To the extent permitted by applicable law, our liability for any claim arising from a production or booking will be limited to the amount paid or payable to Mediawok Co., Ltd. for the relevant services. We will not be liable for indirect or consequential losses, including loss of profit or business opportunity.
Nothing in these Terms and Conditions excludes liability that cannot legally be excluded or limited.
11. Third-Party Services
We may arrange crew, equipment, locations, transport, accommodation and other services from third-party suppliers on behalf of the client.
Where third-party terms or cancellation conditions apply, these may also apply to the client's booking.
12. Governing Law
These Terms and Conditions and any agreement with Mediawok Co., Ltd. are governed by the laws of Thailand.
Any dispute arising from such an agreement will be subject to the jurisdiction of the competent courts of Thailand, unless otherwise agreed in writing.
